If you are talking about RS3, Jagex certainly did what you asked for with the big step of implementing opt-in pvp. If you opt-in pvp, you are consented to fight and RS3 won't stop you.
If you are talking about OSRS, sorry you probably have a better forum to vent your displeasure. You can make new suggestion in the OSRS content suggestion forum, or discuss about how to improve their current pvp mechanisms if you have specific pvp content to target.
As for court case, I don't see how a developer is not allowed to dictate how pvp content is implemented in their own game. RS3 implemented opt-in pvp because they think it is good for the community, not because of any "court case". Otherwise, OSRS will have to change their pvp system too. Shrug!
