To some countries with antiquated laws like Australia, anything random with real money changing hands may be considered "gambling". So Monopoly the board game may be called "gambling" in Australia too. However, being "gambling" doesn't mean illegal gambling. So, all kinds of games of chance are legal there, although technically they still call them "gambling".
And consider TH a fun
Incidentally, this is another interesting subject. Obviously Jagex have no influence over governments legislations, they're not Google or Apple or Facebook or Microsoft or... OK, you got it
So the day TH becomes illegal - or sort of - they'll be switching to something else. I hope they're already thinking about a Plan-B... because that day looks like it's approaching very quickly.
The cosmetic "junk" can sell for decent gp if you don't want it. It is not useless.
I don't think cosmetic overrides are tradable, at least the "junk" I've got e.g. ice warrior outfit. However I don't get all the fuss. If you get something you don't like you can convert them into gp (or oddments!?) straightaway... This is what I do.
In this Crystal Capsules promtions, the cosmetics are tradeable items and go for as much as 20 mil gp.
Not all promotions are equally good in terms of values of the items. It is all up to different players with their various objectives of the game and their own assessments of the values of these items. So inevitably some players may not like some prizes on TH sometimes, but there are also some who put high value marks on other people's "junk".

Good luck waiting for the day when TH becomes illegal. It may not happen at all... or at least no sign whatsoever at all.
I can give you pretty much the picture of the new MTX to replace TH ***IF*** there is a need. Try look at what Pearl Abyss is doing with Black Desert and you get the picture. They don't explicitly put "loot boxes" there but they use an extremely RNG based gear progression system and guess how you get a better chance to get much better progression with your gear? Of course, you pay real money.
Would you be able to tell me how I used 200 keys and did not get one single "event piece"? The amount of time & money I have into this game with over 15 years invested, this is the most misleading I have seen. I get that it is chance or RNG, but if you use that many keys you should get at least a portion of the "promo".
