After studying European law for 3 years, I can tell you no lawsuit can be filled in under any condition because of this update. Jagex Studios Ltd are free to update the game however they see fit. They could put Party Hats on the SGS for free if they wanted too, and you couldn't file a lawsuit for that, although that's a comparable situation. You should also read the T&C for both the membership cards and playing the game. I believe it also says on the membership cards that all items included in the package may be re released.
The fact that it was a "Limited time only" and a "Premium" offer also hold no grounds in a court of law. The items are Jagex's own legal property and they can do what they like with it. The only time you could claim, is if Jagex removed the items from the game after your purchase. In which case they would have to offer a full refund for the Membership card, but they would also revoke a months membership from your account.
Basically you can't sue a company over buyers remorse which is basically what people are claiming. Purchasing one thing, which then becomes available at a better price or at an increased quality, is no grounds to file a lawsuit.
Still, I don't agree with this update, and I feel bad for those who used a dragon keepsake box to override the items just added. I wish my skull was an override too. I think they could make the items an override for everyone, but it's too much trouble for them to bother doing. Oh wellz.
