We will use reasonable endeavours to maintain operation of Jagex Products and rectify faults as quickly as possible. We may have to suspend operation of a Jagex Product without notice for repair, maintenance, improvement or any other reason. If so, we will do our best to ensure that the suspension is as short as possible. We cannot accept responsibility for such suspensions, interruptions or errors caused by circumstances outside our reasonable control.

There is a moral obligation, despite a T&C to provide a basic level of product. It falls under the laws of Reasonable Expectation. You could write in a work contract, "No work may actually be done as part of this contract" and it would not be legally binding, as there is a payment and a reasonable expectation of delivery. There is also the grounds that Jagex did knowingly instigate the behaviour with the DDoSers, without informing the customers of the action. This is a form of negligence.
They could save a lot of face by just rolling back the servers. Or they can lose a lot of customers.
