is it just accounts that are free to play have names freed up? or do they have to have not logged in for x amount of time allso

Last time, only accounts that hadn't been actively played were released. I don't know the specific time period, but I presume if an account has simply logged into the game, the name wouldn't be freed.

so all it takes is a name horder to get wind of this and they simply log each of there accounts in and there names will be kept? that sucks

I believe it has to be a number of years for a name to be auto released.
