That's if you're challenging a ball, like if the ball is in free play, 2 players challenge it and one has a foot higher than waist-chest high, that's a foul for dangerous play. In this case, he has the ball, not challenging it therefore he can have a slightly high foot as there is less risk of collision with another player.
Obviously there's a limit, if it goes to neck-head height, that's dangerous play but it was lower than that.
Besides, overhead kicks are different to bicycle kicks. Overhead kicks just mean you kick the ball over your own head, bicycle kicks mean you flip and hit the ball. Bicycles are more dangerous and that's why lots of bicycle kick goals are disallowed due to dangerous play
